Terms of Service
Last updated: September 6, 2025
These Terms of Service (the “Terms”) govern your access to and use of Peer Hiring’s website, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You may use the Service only if you can form a binding contract with Peer Hiring and are not barred from doing so under any applicable laws. You must be at least 13 years old (or the age of digital consent in your jurisdiction). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and “you” will refer to that organization.
2. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify Peer Hiring of any suspected unauthorized use. Peer Hiring is not liable for any loss or damage arising from your failure to comply with these obligations.
3. Use of the Service
Subject to these Terms, Peer Hiring grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You agree not to (and will not allow any third party to):
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
- Bypass, remove, or circumvent any security or access controls;
- Use the Service to infringe or violate others’ rights, or to transmit unlawful, harmful, or malicious content;
- Access or use the Service to build a competing product or service, or for benchmarking without our prior written consent;
- Interfere with or disrupt the integrity or performance of the Service.
4. User Content
You may submit, upload, or otherwise provide content to the Service (“User Content”). You retain ownership of your User Content. You grant Peer Hiring a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and display your User Content solely as necessary to provide, maintain, and improve the Service, and as otherwise permitted by our Privacy Policy.
You represent and warrant that you have all rights necessary to grant the foregoing license and that your User Content does not violate any law or infringe any third-party rights.
5. AI-Assisted Features
The Service may include AI-assisted functionality that processes User Content to generate outputs. AI outputs may be inaccurate or incomplete and are provided for informational purposes only. You are responsible for reviewing outputs and for any decisions made based on them.
6. Confidential Information
Each party may access the other party’s non-public information that is marked or reasonably understood to be confidential (“Confidential Information”). The receiving party will use the disclosing party’s Confidential Information only to provide or receive the Service and will protect it with reasonable care. The obligations in this Section do not apply to information that is public, independently developed, or rightfully obtained from a third party without restriction.
7. Fees and Payment
If you purchase paid features or subscriptions, you agree to pay the applicable fees and taxes. Fees are non-refundable except as required by law or as expressly stated otherwise. We may change prices with reasonable notice. You authorize us (and our payment processors) to charge your payment method for all fees incurred.
8. Proprietary Rights
Peer Hiring and its licensors own all right, title, and interest in and to the Service (including software, designs, and know-how) and all related intellectual property rights, except for User Content. Except for the limited rights expressly granted in these Terms, no rights are granted by implication or otherwise.
9. Third-Party Services
The Service may integrate with or link to third-party products or services. Your use of any third-party services is subject to their terms and policies. Peer Hiring does not endorse and is not responsible or liable for third-party services.
10. Acceptable Use and Prohibited Conduct
You agree not to use the Service to:
- Violate any applicable law or regulation;
- Infringe intellectual property, privacy, or other rights;
- Distribute malware, spyware, or other malicious code;
- Harass, threaten, or defame individuals or groups;
- Collect or harvest information without consent, including personal data;
- Attempt to gain unauthorized access to systems or networks.
11. Privacy
Please review our Privacy Policy to learn how we collect, use, and share information about you. By using the Service, you acknowledge that we will process your information as described there.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Peer Hiring DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Peer Hiring AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT WILL THE TOTAL LIABILITY OF Peer Hiring FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (I) THE AMOUNTS PAID BY YOU TO Peer Hiring FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (II) ONE HUNDRED U.S. DOLLARS (US$100).
14. Indemnification
You will indemnify and hold harmless Peer Hiring and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
15. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms or pose a risk to the Service or other users. Upon termination, your license and rights under these Terms will cease immediately.
16. Modifications
We may modify these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction where Peer Hiring is established, without regard to its conflict of laws principles. The exclusive venue for disputes arising out of or relating to these Terms or the Service will be the courts located in that jurisdiction, unless applicable law requires otherwise. Each party consents to the personal jurisdiction of such courts.
18. Export and Sanctions Compliance
You represent that you are not located in, under the control of, or a national or resident of any country or person subject to applicable trade sanctions or export restrictions. You agree to comply with all applicable export control and sanctions laws and regulations.
19. General
These Terms constitute the entire agreement between you and Peer Hiring regarding the Service and supersede any prior agreements. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. You may not assign these Terms without our prior written consent; we may assign them without restriction.
